Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker referred a dispute within the meaning of the Industrial Relations Act on 23rd June 2022. In circumstances whereby the Respondent failed to object to the same within the statutory timeframe, the matter proceeded to hearing. This dispute was listed and heard alongside a substantive complaint relating to other legislation. In circumstances whereby the subject matter of the substantive complaint relates to much of the subject matter of the present dispute, and a decision has issued in that matter, I find that it would be inappropriate to make a recommendation in relation to the present dispute. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
In circumstances whereby the subject matter of the present dispute forms part of factual matrix to an alternative complaint between the parties, and a decision has been issued in relation to the same, I find that it would be inappropriate to make any recommendation in relation to the present dispute. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I do not recommend in favour of the Worker or the Employer.
